Florida employment law is among the most flexible in the United States. That is what surprises European directors most, and not always in the direction they expect.

A flexibility that unsettles more than it relieves

Absent a contract or contrary provision, either party may end the employment relationship at any time, without notice or cause. The exceptions are unlawful motives, discrimination and retaliation, which remain prohibited.

A director used to French or Belgian law looks for protective formality and does not find it. They then discover the difficulty has moved to retention: with no legal constraint, an employee leaves overnight, and the corridor market is competitive.

No state income tax does not make employment cheap. Health coverage, which the employer largely bears in practice, represents a cost with no direct equivalent in a European system where health insurance is public.

The employee / contractor line

It does not follow the signed contract but the reality of the relationship: degree of control, integration, economic independence. Reclassification brings back contributions and withholding, retroactively. It is the most common risk for young companies, which start with freelancers to stay light.
